Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CarFile website, mobile applications (iOS and Android), and related services (collectively, the "Service") provided by CarFile Ltd ("CarFile", "we", "our", or "us"), a company registered in England and Wales (Company No. 14550359).

1. Acceptance of Terms

By accessing or using the Service, including downloading our mobile application from the Apple App Store or Google Play Store, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Service Description

CarFile provides vehicle management software including MOT reminders, tax reminders, service tracking, expense management, and DVLA data integration for UK vehicles. The Service is available via web browser and as mobile applications for iOS and Android. The Service is provided "as is" and we continuously work to improve and expand our features.

3. Account Registration

To use our Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorised use
  • Be responsible for all activities under your account

4. Subscription, Payment and Auto-Renewal

Billing: Subscriptions are billed monthly or annually in advance. All prices are in GBP (£). CarFile Ltd is not currently VAT registered. No VAT will be charged.

Free Trial: New users may receive a 14-day free trial with Premium access. No payment information is required to start your trial. At the end of the trial, you will need to subscribe to continue using the Service.

Auto-Renewal: Paid subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. The renewal charge will be the same as your current plan price unless we notify you of a price change in advance.

App Store Purchases: If you subscribe through the Apple App Store or Google Play Store, payment and renewal are managed by the respective platform. Apple's or Google's payment terms apply to those purchases. To cancel an App Store or Google Play subscription, you must do so through the respective platform's subscription management settings.

Money-Back Guarantee: We offer a 30-day money-back guarantee on paid plans purchased directly through our website (via Stripe). For purchases made through the App Store or Google Play, refund requests must be submitted through the respective platform.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are given for unused time within a billing period, except as described in our Refund Policy.

5. End User Licence Agreement (EULA)

By downloading or using our mobile application, you are granted a limited, non-exclusive, non-transferable, revocable licence to use the app for personal or business purposes in accordance with these Terms.

You agree not to:

  • Copy, modify, or distribute the application or its content
  • Reverse engineer, decompile, or disassemble the application
  • Remove any copyright or proprietary notices
  • Transfer or sublicence the application to any third party
  • Use the application in any way that violates applicable laws

This licence is effective until terminated. It will terminate automatically if you fail to comply with these Terms, at which point you must cease all use and delete the application.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorised access to our systems
  • Interfere with or disrupt the Service
  • Transmit viruses or malicious code
  • Violate any applicable laws or regulations
  • Misrepresent vehicle ownership or information

7. DVLA Data Usage

Vehicle data obtained through DVLA integration is subject to DVLA's terms of use. You agree to use this data only for personal vehicle management purposes and not for commercial resale or unauthorised purposes.

8. Push Notifications

The mobile app may send push notifications for MOT reminders, tax reminders, service alerts, and account updates. You can enable or disable push notifications at any time through your device settings. Disabling push notifications may affect the timeliness of important reminders.

9. Account Deletion

You may delete your account at any time by:

Account deletion will result in the permanent removal of your personal data, vehicle records, and service history. Active subscriptions will be cancelled. Some data may be retained as required by law (see our Privacy Policy).

10. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, software, and the underlying code — are owned by CarFile Ltd and are protected by international copyright, trademark, and other intellectual property laws.

11. Limitation of Liability

To the maximum extent permitted by law, CarFile shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless CarFile, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Third-Party Platforms

The mobile application is distributed through the Apple App Store and Google Play Store. Your use of the app is also subject to the respective platform's terms of service:

  • Apple: Apple is not responsible for the app or its content. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation with respect to the app.
  • Google: Google is not responsible for the app or its content. Google Play's terms of service apply to your use of the Google Play Store.

Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.

14. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will notify users of significant changes via email or through the Service.

15. Dispute Resolution

We are committed to resolving any disputes informally where possible. If you have a complaint, please contact us at [email protected] and we will aim to resolve it within 14 days.

If we are unable to resolve your complaint, you may refer the matter to an alternative dispute resolution (ADR) provider. As required under the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015, we inform you that you may also use the UK's online dispute resolution platform, although we are not currently obligated to use ADR.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
